IHL applies during armed conflict and constrains cyber operations used as means or methods of warfare. Distinction requires separating military objectives from civilians and civilian objects. Proportionality prohibits expected incidental civilian harm excessive in relation to the concrete and direct military advantage anticipated. Precautions require feasible measures to verify the objective and avoid or minimize civilian harm. Military necessity does not override these rules, and humanity informs the protection of people from suffering.

Translate principles into system questions. What function makes the object a military objective, and for what period? Is the infrastructure also used by hospitals, water, finance, humanitarian organizations, or civilians? What direct and reverberating effects are expected? How will effects propagate through identity, cloud, DNS, power, communications, and supply chains? Can the action be scoped by time, account, protocol, geography, or function? Can it be reversed? What observation confirms that conditions remain as approved?

The ICRC takes the view that an operation designed to disable a computer or network constitutes an attack under IHL even without physical damage, while state positions differ on loss of functionality. The ICRC also argues for protection of essential civilian data. Present these as important legal debates, not settled universal rules. Qualified counsel must apply the operating state’s position and the facts.

Engineer feasible precautions and abort criteria

Precautions become real through target validation, current dependency mapping, testing, effect containment, timing, monitoring, and authority to stop. Document civilian co-use, specially protected functions, geographic spillover, recovery capability, vulnerable populations, and uncertainty. A technically discriminate capability may still be unlawful if directed at an unlawful target or expected to cause disproportionate harm.

Design controls such as allowlists tied to verified attributes, rate and duration limits, non-propagating delivery, staged authorization, safe failure modes, independent review, and real-time telemetry. Validate assumptions against the live environment because cloud tenancy, routing, hospital dependencies, and partner use can change between approval and execution. Define abort criteria for target movement, unexpected propagation, loss of observation, changed civilian use, or effects exceeding thresholds.

Conduct an Article 36-style weapons review when required for a new weapon, means, or method. Preserve the reasoning and testing evidence. After execution, assess actual civilian and mission effects, investigate variance, and feed lessons into future design. Protection is not a legal paragraph added at the end; it is a continuous technical and command responsibility.
